By using or accessing the Site, registering with the Site, or by clicking to accept or agree to these Terms of Use when this option is made available to you, you signify that you agree to be bound by these Terms of Use and our Privacy Policy located at www.meridianbuyersgroup/privacy, which is incorporated by reference, governs our handling of all personal information we receive and collect from you through this Site.

This Site is offered and made available to users who agree to be bound by these Terms of Use, are 18 years of age or older, and are residents of the United States of America. This Site is solely intended for lawful, personal, informational, and non-commercial uses. Access to this Site may be prohibited or restricted in countries outside of the United States of America. Access to this Site from outside the United States shall be at the user’s sole risk.

Payment Options

We offer you a variety of payment options, including Recurring Auto Draft from your Checking or Savings Account and Payment by Phone, Mail, in Person, or Online. To learn more about these options and their terms, visit: https://meridianbuyersgroup.com/customers/.

By clicking the “Make A Payment” link available on this Site, you will be directed to the secure web portal of our third party payment processor, Payment Vision: https://web.paymentvision.com/meridianbuyersgroup/login.aspx. Online payments submitted by you through the Payment Vision website are made via e-check (also called an Automated Clearing House or ACH transaction) and applied to your loan with us, subject to submission of accurate and complete payment details. As an authorized agent of Meridian, PaymentVision will transmit your payment instructions to the banking clearinghouse that will process this payment. PaymentVision may charge you a Convenience Fee for accessing this Service, in addition to your payment to Meridian. All terms applicable to your payment transaction, including the amount of any Convenience Fee, will be presented to you before you complete your payment transaction.

Successful completion of your payment to Meridian is contingent upon your bank’s authorization of both of the ACH transactions and receipt of funds. If the payment information entered is inaccurate, or your payment is not authorized and processed, your payment to Meridian will not be completed and you will be responsible for all resulting penalties, late fees, bank fees, returned or dishonored check fees, and interest charges. You represent and warrant that you have full legal authority to authorize ACH transactions on the account you enter. You must be at least 18 years of age to use the Service. PaymentVision reserves the right to refuse service, or suspend or terminate your access to the Service at any time. In order to gain access to your account through the Payment Vision portal, you will need to provide certain credentials to verify your identify, such as your Account Number and the last 4 digits of your Social Security Number. If you have any difficulty using the Payment Vision website or are seeking reasonable accommodations for other ways to make your payment, please call our office at (615) 356-0023.

You may pay by check if the account is restricted to payment by cash only. When setting up online billing, you will be asked to provide your account number, mailing address, and a routing number and checking account number. You may pay by Visa, Discover Card, or MasterCard or by debit card, provided that the debit card bears a Visa, Discover Card or MasterCard logo. You will be asked to provide the card number and expiration date.

Once you have made an online payment, you will be asked to verify that the information on file is correct for the next transaction. In the event such information has changed, you will be able to correct or enter new payment information. We encourage you to retain copies of all transaction receipts that we or Payment Vision provide to you in connection with any of the above services.

Use of Site

You may use this site only for lawful, non-commercial, non-public, personal use, such as viewing information about products and services offered by Meridian, in accordance with these Terms of Use. Any transactions that you enter into with a vendor, merchant, or third party listed in this site or linked from this site are solely between you and that vendor, merchant or third party and subject to any terms and conditions imposed by them.

Information about products, such as payment amounts, are reasonably estimated in this Site, and may not be equal to actual amounts. Actual payment amounts may differ from those amounts provided in this Site, based on factors such as creditworthiness and contract terms. Information about and links to credit improvement resources, creditors’ rights, and calculations are provided for convenience and informational purposes only.

If you apply for credit through us, you may subsequently need to submit additional information in order to fully complete the processing of your application. After your credit application is fully processed, Meridian will forward to you via U.S. Mail a notice of adverse action if any such adverse action applies to your application for credit. Additionally, if you are a resident of Ohio, Meridian will forward to you via U.S. Mail a notice of approval if adverse action does not apply to your application for credit.

Prohibited Uses

You agree not to:

• use the Site in any way that violates federal, state, local or international law or regulation, or generally accepted practices or guidelines in relevant jurisdictions (including any laws or regulations regarding the export of data or software to and from the United States or other relevant countries);

You are solely responsible for (and that the Meridian has no responsibility to you or to any third party for) any breach of your obligations under these Terms of Use and for the consequences (including any loss or damage which you may suffer) of any such breach.

Maintaining Your Online Account

If you establish an Online Account, you are responsible for all activities occurring under your Online Account and for keeping your username, password, and Online Account information confidential. Therefore, you should not provide your username, password, or any other log-in credentials associated with your Online Account to any other person. If you suspect someone is accessing or using your Online Account without your permission, or if you need to change your password or Online Account information, please notify us immediately by contacting us by telephone at 615) 356-0023.

You agree to (i) maintain the confidentiality and security of your username and password, (ii) promptly update any information you provide to us in connection with your account and to keep it accurate, current and complete, and (iii) be fully responsible for all use of your account and for any actions that take place using your account. Governing Law

To the fullest extent permitted by law, these Terms of Use and any claim or dispute arising out of or related to these Terms of Use will be governed by and construed in accordance with the state and federal laws of the State of Tennessee, without regard to its choice of laws principles. Except as otherwise prohibited by law, any claim or dispute must be brought within one (1) year from the date such cause of action arises. Any claim or dispute arising out of or relating to these Terms of Use shall be subject to the exclusive jurisdiction of state or federal courts located in Davidson County, Tennessee, and you hereby submit to the personal jurisdiction of such courts.

Some states do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you.
